November 14: Advocating for Veterans: The Basics on VA Benefits, Discharge Upgrades and Veteran Cultural Competency 2018

There are over 21 million veterans in the U.S.; many of them are not aware of the benefits to which they are entitled. Medical and financial assistance are available to those who have served in the military, but many veterans most in need are not receiving VA benefits. Navigating the VA claims system and applying for discharge upgrades before the Department of Defense are difficult and complex processes. Attorneys play an essential role in removing barriers to VA benefits, such as:
  • Lack of evidence to “service-connect” their injuries or disabilities.
  • Lack of current medical or mental health evidence documenting severity of symptoms for accurate disability ratings.
  • VA eligibility determinations for those given less than fully honorable discharges for behaviors that were related to minor disciplinary infractions or symptoms of Post Traumatic Stress or other service-related disabilities.
Nearly 45% of veterans returning from Iraq and Afghanistan seek compensation from the Department of Veterans Affairs (VA) for service related injuries; 30% of these veterans who file for VA benefits include claims for Post-Traumatic Stress. Many of those who should receive benefits will be denied. Many service members who may be VA eligible are unaware of their legal right to pursue VA benefits, and of those who do apply, more than 90% will be denied. All of them will wait months or years for the VA to issue decisions on their claims. Learn how to navigate the VA claims process and to become an effective advocate for veterans in need. This all-day program will provide an overview of VA disability law and military discharge review law. You will gain an understanding of different types of military discharges, why they are important, and how you can help veterans with less than Honorable discharges.
IMPORTANT! If you get accredited by the VA before you attend this training, the first three hours will satisfy the VA’s CLE requirement. 1. Attorneys and other advocates must be accredited to practice before the VA. To obtain accreditation you must complete this form: www.va.gov/vaforms/va/pdf/VA21a.pdf. 2. Accreditation by the VA may take several weeks, so do not delay filing your application. You can speed up the process by emailing the form to OGCAccreditationMailbox@va.gov. 3. Within 12 months after accreditation you are required to complete three hours of qualifying CLE. The morning session of this program satisfies that requirement, but only if you have already received your accreditation from the VA. If you have not received it, you should still watch this program, but keep in mind that you will need to complete three additional hours of CLE within 12 months after receiving your accreditation. 4. Attorneys and other advocates who become accredited will be listed on a national VA list, and are entitled to represent veterans in their claims for benefits, on a pro bono basis, and for attorney’s fees on appeals, where they are available. Who Should Attend: Attorneys seeking meaningful pro bono opportunities and any advocate who wants to help change the life of a veteran with a disability. Attorneys seeking to meet VA’s CLE requirements for new and continuing VA accreditation should also attend. Finally, attorneys who hope to expand their practice areas to include veterans’ cases where fees are available should register for one or more of the sessions.

December 18: Webcast - Better Serving Older or Disabled Veterans: A Special Session on the Intersections between Veterans Benefits, Social Security, and Medicaid

Register Now For Free!
Description: Well over one-half of the American Veteran population is elderly or disabled and entitled to a wide-range of government benefits— from income to health care to in-home services. These benefits can help a veteran and their family stave off poverty, prolong independence, and receive the supportive services they need to thrive. Yet, while many elder law, disability rights, and benefits practitioners are versed in Social Security and Medicaid, few attorneys are aware of how these benefits intersect with benefits from the Department of Veterans Affairs.
As part of PLI’s Advocating for Veterans series, this free half-day session will empower practitioners with the tools they need to maximize their Veteran clients’ income and well-being, and to better meet their health care and long-term needs. More specifically, expert veterans and government benefits attorneys will provide practitioners with an in-depth understanding of the Department of Veterans Affairs’ lesser known Non-Service-Connected Pension benefit and break down the interplay between VA Benefits, Social Security benefits, Medicaid, and In-Home Supportive Services.
What You Will Learn
  • How to determine whether a Veteran is eligible for VA Non-Service-Connected Pension, including how to reduce a Veteran’s countable income in order to ensure entitlement and maximize income
  • How VA Benefits and Social Security benefits intersect, including how they offset one another, the main differences between VA Non-Service-Connected Pension and SSI, and the impact of VA Non-Service-Connected Pension on SSI
  • How to prolong a Veteran’s independence by using VA Non-Service-Connected Pension with or without In-Home Supportive Services to pay for in-home care and assisted living
  • How to expand a Veteran’s long-term care options using VA Benefits, Medicaid, and In Home Supportive Services
Who Should Attend
  • Attorneys and advocates that work with or are interested in serving American Veterans will benefit from this program.
  • Elder law, disability rights advocates, and government benefits advocates may find the session particularly applicable to their practice areas.
  • IMPORTANT! If you are a VA-accredited attorney and have already completed the VA’s initial CLE requirement, this program may satisfy the VA’s continuing CLE requirement to maintain accreditation.

Veterans Consortium Pro Bono Program Training - Sign up Now!

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.

May 14/Web: Meeting Legal Needs of Homeless and At-Risk Veterans: VHA Programs for Justice-Involved Veterans

Earlier this year, the National Coalition for Homeless Veterans (NCHV) Technical Assistance (TA) Center hosted a training webinar on best practices for meeting the legal needs of homeless veterans to remove barriers to employment. This training introduced successful court models that connect veterans seeking treatment to needed legal services that prevent incarceration. When asked for additional needs after this training, webinar participants overwhelmingly requested more information on engaging with partners at their local VA Medical Centers to provide legal services.
On Tuesday, May 14, 2013, at 3 p.m. EDT, the NCHV TA Center will host “Meeting Legal Needs of Homeless and At-Risk Veterans: VHA Programs for Justice-Involved Veterans.” This Level II Training Webinar will feature issue-experts from the U.S. Department of Veterans Affairs, Veterans Health Administration: Sean Clark, National Coordinator, Veterans Justice Outreach, and Jessica Blue-Howells, National Coordinator, Health Care for Reentry Veterans.
For the past seven years, the Veterans Health Administration (VHA) has been providing direct outreach to veterans re-entering the community after serving a term in prison. Additionally, for the past four years, VHA has been providing direct outreach to veterans involved in arrests, jail incarceration, and treatment courts. Participants in this webinar will obtain a baseline understanding of the needs of justice-involved veterans and two VHA models that have been developed to assist veterans along the continuum of justice involvement.

April 26/Teleconference+Minneapolis: ULC Deployed Parents Visitation and Custody Act

The deployment of a custodial parent raises custody issues that are not adequately dealt with in the law of most states. In many instances, deployment will be sudden, making it difficult to resolve custody issues before the deployment by ordinary child custody procedures. There is a need to ensure that parents who serve their country are not penalized for their service, while still giving adequate weight to the interests of the other parent, and most importantly, the best interest of the child.
Due to the patchwork of various laws across the country and consistent with its mission to harmonize state law, the Uniform Law Commission recently passed the Uniform Deployed Parents Custody and Visitation Act (UDPCVA), a uniform statute that states may adopt to govern child custody and visitation rights when a service member with children is deployed for military service. The Act includes provisions regarding custody and visitation rights during the deployment of a service member, addresses issues regarding a service member's delegation of custody rights, and establishes clear procedures for the resumption of the previous custody arrangement.
Two Minnesota attorneys who served as subject matter experts for the ULC's UDPCVA drafting committee, Kim Bonuomo, family law attorney and shareholder at Moss & Barnett, and Major Lyndsey Olson, General Counsel of the Minnesota National Guard will discuss the provisions of the UDPCVA and what effect passage of UDPCVA would have in Minnesota.

March 19/Web: Meeting Legal Needs of Homeless and At-Risk Veterans: Homeless Court Programs and Veteran Treatment Courts #MCLE

For 25 years, Homeless Court Programs (HCP) have used close collaboration between the criminal justice system and service providers to aid homeless veterans in providing proof of engagement with rehabilitation and treatment services to address misdemeanor offenses. For veterans with disabling psychological conditions facing possible incarceration, alternative sentencing programs through Veteran Treatment Courts (VTC) provide an avenue to appropriate treatment, gainful employment and housing stability. Homeless veterans must often address misdemeanor charges, discharge upgrades, child support issues, and other legal issues that can act as barriers to training, education, employment placement, and career growth. Participants in this training will obtain a baseline understanding of court models developed to provide alternatives to incarceration and remove legal barriers to employment placement, permanent housing stability, and availability of treatment services. Speakers will outline important partners in each court model and strategies for engaging with existing courts and developing new courts. Title: Meeting Legal Needs of Homeless and At-Risk Veterans: Homeless Court Programs and Veteran Treatment Courts When/Where: Tuesday, March 19, 2013 3 p.m. EST (Noon PST) Webcast Speakers:
  • Steve Binder, Deputy Public Defender and founder of the nation’s first Homeless Court
  • Matt Stiner, Director of Justice for Vets. HVRP Best Practice grantee Veterans Outreach Center.
